These Terms of Use (the "Terms") govern the use of the RCam Inspect application (the "App") and its companion website. By creating an account or using the App, you ("you", the "User") agree to these Terms and to the Privacy Policy, which forms an integral part of these Terms. If you do not agree, you must not use the App.
RCam Inspect is a professional tool for inspection work and reporting, intended for persons aged 18 and over. If you use the App on behalf of an organisation, you confirm that you are authorised to bind that organisation to these Terms.
You sign in with an email address and password, or with a Google account. Each account may be used on one device at a time; signing in on a new device ends the session on the previous device. You are responsible for keeping your sign-in credentials secure and for all activity carried out under your account, and you must notify us promptly if you suspect unauthorised use of your account.
RCam Inspect is owned by its developer, Tinh Nguyen ("we", "us"). We grant you a personal, non-exclusive, non-transferable and revocable licence to use the App for your work. Except to the extent permitted by law, you may not copy, modify, reverse engineer, resell or rent the App, create derivative works from it, or interfere with its licensing and activation-code mechanisms. Interference with the licensing mechanism constitutes grounds for immediate termination of access.
You retain ownership of the photos, videos, descriptions and reports you create. You grant us a non-exclusive, royalty-free right to store, transmit, make technical copies of, back up, cache, convert the format of and otherwise process that content to the extent necessary to: operate the features you use; maintain system security; diagnose and resolve faults; and comply with legal obligations. This right ends when you delete the content or your account, except for transient technical copies and the cases set out in the Retention and deletion section of the Privacy Policy.
By placing content in the App, you represent and undertake that:
You agree to indemnify the developer against losses and reasonable costs arising from third-party claims relating to content you place in or share through the App.
We do not proactively review the content of your reports. We access content only where necessary to operate or troubleshoot the service; to provide support at your request; to handle a report of a violation or suspected abuse under Section 8; or where required by law.
Where a company administers a group of accounts, that company is responsible for: informing its members that data is shared within the group and of the settings applied to their App; and ensuring that it has a valid legal basis for processing the data of its personnel. For data within the scope of the group, we process such data on the company's instructions.
The company administering the group agrees to indemnify the developer against losses and reasonable costs arising from claims, demands or sanctions by group members or public authorities relating to the company's collection, sharing or monitoring of member data through the group.
You must not use RCam Inspect to:
Abuse or infringing content should be reported to rutyphon@gmail.com. We review reports within a reasonable time and may remove content and suspend or terminate the infringing account. Such review is a right we reserve and not an undertaking to reach any particular outcome.
The artificial intelligence features in RCam Inspect are in a trial (beta) stage. They include: text recognition (OCR); on-device suggestions for photo names and photo order; network-based photo naming; customer-code recognition from photos; defect classification; and content summaries.
With respect to these beta features:
You are responsible for verifying results produced by artificial intelligence before including them in a formal report or relying on them for a business decision. Such results do not constitute inspection evidence and do not replace the inspector's own assessment. We are not liable for any loss arising from reliance on results produced by artificial intelligence.
Section 7 of the Privacy Policy sets out the data transmitted off the device for each of the features listed above.
RCam Inspect is provided "as is" and "as available". We may add, change, suspend or remove features, and may require a minimum App version for continued use of online features. We do not warrant that the service will be uninterrupted, error-free, free from data loss or fit for a particular purpose.
Discontinuation of the service. We may discontinue a plan (including the free plan) or the service as a whole. In the case of a planned discontinuation, we will give reasonable advance notice to allow you to export your data; fees for any unused portion of a paid billing period are refunded in accordance with Google Play's policy. We may discontinue the service immediately and without notice where required for legal or safety reasons, or where an infrastructure provider ceases its service.
Experimental features. Features marked as experimental, preview or beta may not function correctly and may be changed or withdrawn at any time; they should not be used for work that cannot be repeated.
Backups. You are responsible for keeping your own backups of important files (exported Word and Excel files and original photos stored elsewhere). Online backup is a convenience and not a guarantee of permanent storage.
Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including outages, policy changes or service withdrawal by infrastructure providers and app stores (Google, Firebase, Anthropic and similar providers), power failures, network failures, cyber-attacks, natural disasters, epidemics, or acts of public authorities.
To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for loss of data, profits or business opportunities, arising from your use of or inability to use the App. Our total liability in any event shall not exceed the amount you paid for the service in the preceding 12 months. Nothing in these Terms excludes liability that cannot lawfully be excluded.
We may suspend or terminate your access if you breach these Terms. In such cases, we will provide a reasonable explanation of the reason, except where prohibited by law, where the details would disclose our methods of detecting fraud, or where doing so would put other users at risk.
You may stop using the App at any time and delete your account in the App (Settings > Account > Delete account) or on the website; detailed instructions are available at rcaminspect.com/delete-account.html. Upon termination: Google Play subscriptions are handled in accordance with Google Play's policy; activation codes are non-refundable; and data is deleted as described in the Retention and deletion section of the Privacy Policy.
Retention of data in the event of a dispute. Where there is an ongoing dispute, claim, abuse investigation or request from a public authority concerning your account, we may retain the data necessary for that purpose for as long as necessary, including after termination of the account, and will use such data solely for that purpose.
These Terms are governed by the laws of Vietnam. The parties shall first seek to resolve any dispute through good-faith negotiation; if the dispute is not resolved within 30 days, it shall be settled by the competent courts of Vietnam. If you are a consumer, this provision does not affect the mandatory rights granted to you by the law of your place of residence.
We may update these Terms; for materially unfavourable changes, we will give advance notice in the App or on the website. Your continued use of the App after a change takes effect constitutes acceptance of the updated Terms. If any provision is held invalid, the remaining provisions remain in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us concerning the use of the App.
Assignment. You may not assign your rights or obligations under these Terms without our consent. We may assign our rights and obligations to a successor in the event of a merger, acquisition or sale of the product, provided that the successor is bound by these Terms.
No waiver. Our failure to exercise any right under these Terms shall not constitute a waiver of that right.
